BiRide Terms & Conditions
1. Contractual Relationship These Terms & Conditions (“Terms”) govern your use of the BiRide mobile application, electric bicycles, and related services (the “Services”). They form a binding legal agreement between you (“User”) and Bisaggio Cyprus Ltd, trading as BiRide. By registering an account, renting a BiRide bicycle, or otherwise using the Services, you confirm that:
➤ You have read, understood, and agree to be bound by these Terms and the Rider agreement.
➤ You are of legal age and capacity to enter into a binding contract. If you do not agree, you must not use the Services. BiRide may update or modify these Terms at any time. Changes take effect when posted in the app or on our website. Continued use after changes means you accept the revised Terms.
2. Assumption of Risk & Waiver of Liability
2.1. Ride at Your Own Risk Riding an electric bicycle involves inherent risks. You acknowledge that you use the BiRide Services entirely at your own risk.
➤ Medical: You are responsible for your own medical insurance. BiRide does not provide Personal Accident coverage.
➤ Equipment: You are responsible for the safety and condition of the bicycle while it is in your possession.
➤ Weather & Road Conditions: You acknowledge that weather conditions (rain, wind, storms) and road surfaces (wet cobblestones, slippery pavement, sand) significantly affect safety. Specific Warning: Surfaces such as the cobblestones in Paphos Harbour become extremely slippery when wet. BiRide is not liable for accidents caused by poor weather or slippery surfaces. If you choose to ride in such conditions, you assume 100% of the risk.
2.2. Helmet Use Disclaimer Under Cyprus law, the use of a helmet is not mandatory but is strongly recommended by BiRide.
➤ Where a helmet is provided, its use is voluntary.
➤ You accept full responsibility for any injuries resulting from the decision not to wear a helmet. BiRide shall not be held liable for any head injuries sustained while riding.
2.3. Release of Liability By using the Services, you release and hold harmless BiRide, its officers, and employees from all claims, injuries, or losses arising from your use of the Service, except where such loss arises directly from BiRide’s proven negligence (e.g., equipment failure due to lack of maintenance).
3. Services Provided BiRide offers a platform for renting GPS-enabled electric bicycles with smart locks. Features can include:
➤ Real-time tracking of bike status (battery, location).
➤ Renting and unlocking bikes through our Rider App.
➤ Secure payment processing.
➤ BiRide does not guarantee bike availability at all times or locations. Availability may vary due to demand, maintenance, or operational constraints.
➤ Weather Restrictions (Service Suspension): BiRide reserves the right to temporarily suspend the Service, disable bicycle unlocking mechanisms, or recall bicycles remotely in the event of severe weather or unsafe riding conditions (e.g., heavy rain, storms, extreme wind). This measure is taken for safety reasons and may be implemented without prior notice to Users or partner venues (Hotels).
4. Account Registration & Use
➤ You must register an account with accurate personal details and a valid payment method if renting via the app.
➤ You are responsible for all activity under your account.
➤ Fraudulent information or payment methods will result in immediate suspension or termination.
5. User Responsibilities You agree to:
➤ Use BiRide bicycles safely and responsibly.
➤ Comply with local traffic laws.
➤ Not ride under the influence of alcohol or drugs.
➤ Not carry passengers or heavy/bulky items.
➤ Park responsibly within designated areas.
6. Age Requirement Users must be at least 16 years old to rent BiRide electric bicycles. Underage use is strictly prohibited. Any account used in violation of this age requirement renders the account holder fully liable for all resulting actions, damages, penalties, and legal consequences.
7. Rental Terms & Fees
➤ All rentals are charged per ride or via wallet top-up. Prices and fees are shown in the app and may change from time to time.
➤ All Bookings require a €100 security deposit per bike.
➤ BiRide may pre-authorize your payment method to confirm validity. By adding a payment method to your account, you explicitly authorize BiRide to automatically charge this card for any outstanding balances related to damages, extreme cleaning, missing parts, or emergency call-out fees that exceed the initial security deposit.
➤ Unreturned or abandoned bikes may incur retrieval fees.
7.1. Standard Refund, Deposit Retention & Post-Rental Inspection Policy Standard deposit refunds are processed on the same day the bicycle is returned, strictly using the original method of payment (cash refunds for cash deposits, and card refunds to the original card for card transactions).
However, we reserve the right to withhold the full deposit amount at the time of the bicycle’s return if its condition raises concerns, or if excessive dirt and mud prevent the immediate, on-site verification of potential mechanical damage.
Crucially, if the deposit is not returned to the Renter on the day of drop-off, this non-return serves as a definitive, mutual agreement and undeniable proof between both parties that the bicycle’s condition required further investigation. The Renter acknowledges that leaving the premises without the deposit confirms their awareness that an issue exists (e.g., suspected damage or extreme dirt). This retained deposit secures the process of transferring the bicycle to our technical service team for proper preparation (including specialized cleaning) and the creation of a detailed post-rental inspection report.
Inspection Timeline & Communication: Following the retention of the deposit, BiRide commits to conducting the technical inspection and providing the Renter with the official results—including an itemized cost estimate for cleaning and repairs, if applicable—within seven (7) working days. All correspondence regarding the inspection, costs, and deposit status will be conducted strictly via email at admin@biride.com. Both parties agree that this specific email correspondence constitutes the only official, legally binding proof of the proceedings and agreements.
7.2. Market Valuation, Logistics, and Labor Costs Premium electric bicycles require specialized care. All costs related to repairs, the replacement of damaged parts, and service labor are calculated based on current market prices within the European Union, strictly factoring in shipping logistics and the availability of spare parts in Cyprus. In addition to the cost of replacement parts, a service labor fee for a qualified mechanic will be applied at a fixed rate of €40.00 per working hour (billed proportionally to the time required for the repair).
7.3. Costs Exceeding the Deposit & Payment Terms If the total cost of restoring the e-bike to its original operational condition (including specialized cleaning, spare parts, and labor) exceeds the secured deposit amount, the Renter is legally obligated to cover the outstanding balance based on the provided official repair estimate. To ensure full transparency, the entire verification process, the technical report, and photographic documentation (showing the ‘before’ and ‘after’ condition) will be communicated exclusively via email to the address provided by the Renter. The Renter must transfer the outstanding balance to a bank account specified by BiRide within seven (7) working days from the date the official notification and cost estimate email is sent (unless successfully charged automatically to the registered payment method). Failure to settle the outstanding balance within this timeframe will result in legal action or the involvement of debt collection agencies.
The Renter agrees to be held fully liable for all associated legal fees, court costs, and debt collection expenses incurred by BiRide in the process of recovering the outstanding balance.
7.4. Emergency Call-Out & On-Site Assistance We provide an emergency call-out and rescue service for situations requiring on-site assistance (e.g., flat tires, drained batteries, lost keys, or user-inflicted damage). Please note that this service is fully chargeable if the call-out is a result of the Renter’s actions, negligence, or natural hazards (such as punctures). The standard call-out fee applies strictly during our regular business hours. Requests for assistance outside of these hours, including nights, Sundays, and public holidays, are subject to significant surcharges or individual pricing based on staff availability. If the issue is proven by our technicians to be a pre-existing mechanical failure not caused by the Renter, the call-out fee will be waived. Minimum charges apply as detailed in our Damage & Loss Fees schedule (minimum €60.00).
7.5. Additional Restrictions and Liabilities:
➤ Territory of Use: Use is limited to the Republic of Cyprus south of the UN Buffer Zone. Crossing into the north is prohibited and will incur a minimum penalty of €3,000 plus recovery costs (GPS-monitored).
➤ Accommodation & Delivery Restrictions: For insurance and local support purposes, the Renter must maintain a single, fixed temporary residence address for the entire duration of the rental. We do not provide rentals to individuals engaging in “backpacking” or those changing accommodations across multiple locations.
➤ BiRide does not offer airport pickup or drop-off services.
➤ Transport & Carriage: Bikes may not be transported in car trunks. Only rolling or certified e-bike racks are permitted. The user is liable for damages caused by improper transport.
➤ Prohibited Use / Terrain: No extreme sports, off-road, beach or saltwater riding, modifications, or passengers.
➤ Helmet & Safety: Helmet use is strongly recommended but voluntary. Bikes must be properly locked when not in use.
➤ Battery & Charging: Only use the BiRide-provided charger, in a dry and ventilated area. Keep away from water or heat.
➤ Damage, Theft, Loss: Report immediately as per the procedures in Section 8. You are fully liable. Costs may be deducted from your deposit or payment method, as detailed in the Damage & Loss Fee Schedule.
➤ Late Return: At least one full day’s rental fee for any late return, plus one additional day’s fee for each additional day late.
➤ Deposit & Deductions: BiRide may deduct amounts for repairs, missing accessories, cleaning, service calls, administrative fees, contractual penalties, and loss of use.
➤ GPS & Privacy: GPS tracking is active during rentals. Data may be processed and disclosed to police if legally required.
7.6. Child Seats / Carriage of Children: If you choose to use a BiRide bicycle that is fitted with a childseat, you acknowledge and agree that:
➤ The child seat is installed by BiRide solely as a courtesy. BiRide does not warrant or guarantee the condition, suitability, or safety of the seat or its compatibility with your use.
➤ You are solely responsible for ensuring that any child is properly seated, secured, and equipped with appropriate safety gear (helmet, harness, etc.).
➤ You assume all risks, including injury, equipment failure, or death, arising from the installation or use of the child seat.
➤ To the fullest extent permitted by law, BiRide and its staff are not liable for any loss, injury, damage, or death resulting from the installation or use of the child seat.
➤ By using the Services with a child seat, you waive and release BiRide from all claims related to the child seat or transport of a child on the rental bike.
7.7. Bike Substitution: BiRide reserves the right to substitute the bicycle provided with another of the same rental category and price in the event of unforeseen circumstances, such as maintenance issues, damage, or availability constraints.
➤ The replacement bike will be of comparable type, specifications, and rental price, as determined solely by BiRide.
➤ Riders will be informed of the substitution as soon as possible.
➤ BiRide is not liable for any inconvenience, delays, or minor differences in equipment between the originally booked and replacement bike.
8. INSURANCE AND LIABILITY LIMITATIONS 8.1. Third-Party Liability Only BiRide maintains a Public Liability Insurance policy. This coverage is strictly limited to damages caused to third parties (e.g., pedestrians, other vehicles) by the use of our bicycles, subject to the insurer’s terms and limits (€50,000 per accident).
8.2. CRITICAL EXCLUSIONS (What is NOT covered) You explicitly acknowledge and agree that BiRide’s insurance DOES NOT COVER:
➤ Damage to the Bicycle: You are fully financially responsible for any damage, theft, or loss of the BiRide bicycle, battery, and accessories. You must pay for all repairs or replacement costs (up to the full value of the bike) regardless of fault.
➤ Personal Injury: You are NOT covered for your own bodily injury, medical expenses, ambulance costs, or disability. You are strongly advised to possess valid personal medical/travel insurance.
8.3. Insurance Excess (Deductible) Our Third-Party Liability policy carries a mandatory Excess (Deductible) of €500 per claim. In the event you cause damage to a third party, you agree to pay this initial €500, or the full amount of the claim if it is less than €500.
8.4. Negligence & Traffic Violations According to our insurance terms, coverage may be denied if an accident results from your negligence (e.g., traffic violations, reckless riding, riding under influence). In such cases, you will be personally liable for 100% of all damages to third parties, in addition to damages to the BiRide bicycle.
8.5. MANDATORY Reporting Procedure (24-Hour Rule) To activate any potential Third-Party coverage, you must report the Incident to BiRide immediately, and in no event later than 24 hours from the occurrence.

9. Group Rides You may add one additional rider under your account. You are responsible for ensuring that the second rider:
➤ Is at least 16 years old.
➤ Uses the equipment safely.
➤ Complies with these Terms. The account holder is fully liable for all costs, damages, and penalties arising from any additional rider’s use.
10. Support & Dispute Resolution If you believe you have been wrongly charged or experience a problem, contact BiRide Support within 10 business days. We aim to resolve disputes promptly and professionally. If disputes cannot be resolved amicably within 30 days, they may be submitted to arbitration or the courts of Pafos, Republic of Cyprus.
11. Termination BiRide may suspend or terminate your account without notice for violations of these Terms, fraudulent behavior, or unsafe conduct. You may close your account at any time through the app.
12. Limitation of Liability To the fullest extent permitted by law, BiRide is not liable for indirect, incidental, or consequential damages, loss of data or income, or injury resulting from misuse or unavailability of the Services. Your use of the Services is at your own risk.
13. Intellectual Property All logos, trademarks, branding, software, and other intellectual property of BiRide are owned by Bisaggio Cyprus Ltd. You may not copy, reproduce, or use them without prior written consent.
14. Governing Law & Jurisdiction These Terms are governed exclusively by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pafos, Cyprus. In the event of discrepancies between language versions, the English version prevails.

16. Cancellation and Refund Policy General Terms: Customers may cancel their e-bike rental by notifying BiRide in writing (via email or the BiRide booking portal). The following cancellation charges apply based on the time remaining before the scheduled rental start date.
Cancellation Fees:
➤ More than 14 days before the rental start date: Full refund, no cancellation fee.
➤ Within 14 days of the rental start date: A cancellation fee equal to 25% of the total rental value will be charged to cover administrative and reservation costs.
➤ Within 72 hours of the rental start date: A cancellation fee equal to 50% of the total rental value will apply. This represents the full deposit amount required to secure the booking and reflects preparation and opportunity costs associated with short-notice cancellations.
➤ No-show or cancellation after rental start: No refund will be issued.
Right of Withdrawal: Under Article 18(1)(l) of the Consumer Protection Law 13(I)/2013, the statutory 14-day right of withdrawal does not apply to leisure service bookings (such as e-bike rentals) that are scheduled for a specific date or period.
Refund Process: Any eligible refunds will be processed using the same payment method used for the booking, within 10 business days of receiving a valid cancellation notice.
Exceptional Circumstances: BiRide reserves the right to offer a rescheduling option or credit voucher in cases of proven emergencies or exceptional circumstances (e.g., illness, travel disruption, or extreme weather conditions).
Acceptance: By confirming your booking, you acknowledge and agree to the above cancellation and refund terms.
