BiRide Rider Agreement

This Rider Agreement (“Agreement”) governs your access to and use of the BiRide electric bicycle rental services, mobile applications, websites, and any related equipment or services (collectively, the “Services”). By creating an account, renting or using a BiRide electric bicycle, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree, do not use the Services.

The Services are provided by Bisaggio Cyprus Ltd, Morozos 12, Tsokkas Villa 3, 8220 Chloraka, Paphos, Cyprus (“BiRide”).

1. Eligibility and Account Registration

Account Holder: You must be at least 18 years old to register an account and adhere to these terms.

Rider Age: Riders must be at least 16 years old. If you allow a minor (16+) to use a bike rented under your account, you accept full liability for their actions and safety.

You must provide accurate, complete, and up-to-date information when creating an account and keep your login credentials secure. You are fully responsible for all activity under your account.

2. Description of Services

BiRide provides premium electric bicycles equipped with high-capacity batteries, smart locks, and GPS tracking. Our iOS and Android app enables you to:

Locate and reserve bicycles.

Unlock bicycles via QR code.

Track rides and manage payments.

3. Safety & Insurance Obligations

Helmet: Under Cyprus law, helmets are voluntary. However, BiRide strongly recommends wearing a safety helmet at all times. If you choose not to, you do so at your own risk.

Weather Conditions: Riding in rain, on wet surfaces, or in strong winds is dangerous. Specific Warning: Surfaces like the cobblestones in Paphos Harbour become extremely slippery when wet. You are advised to stop riding immediately if rain begins. BiRide accepts no liability for falls or accidents resulting from weather or road conditions.

Pre-ride check: Before each ride, check brakes, lights, battery level, tire condition and other safety features.

Lawful riding: Obey all applicable traffic laws. Do not ride under the influence of alcohol, drugs, or any substance that may impair your judgment.

Insurance Coverage & Gaps:

➤ Liability: BiRide provides Third-Party Liability insurance (damages to others), subject to a €500 Excess fee payable by you.

➤ Medical: You are NOT covered for your own injuries. You must have your own medical insurance.

➤ Bike Damage: You are NOT covered for damage to the BiRide bicycle. You must pay for any damage you cause to the bike.

Battery charging: Only use the BiRide charger supplied. Charge in a dry, ventilated area away from heat or water.

4. Permitted Use

Bicycles may be used only for personal, non-commercial transportation.

Do not tamper with, modify, or disassemble any bicycle.

Do not carry passengers, animals, or large items.

Maximum rental duration is 24 hours per session. Failure to return within this time may result in the bicycle being treated as lost or stolen.

Territorial limits: Use of BiRide bicycles is permitted only in the Republic of Cyprus, south of the UN Buffer Zone. Crossing into the north is strictly prohibited and will result in a minimum penalty of €3,000 plus recovery costs.

Transport: Bicycles may be transported only by rolling or on certified e-bike racks. Trunk transport or any other method likely to damage the bicycle is prohibited. You are liable for damages caused by improper transport.

Bike Substitutions:

BiRide reserves the right to substitute the bicycle provided with another of the same rental category and price in the event of unforeseen circumstances, such as maintenance issues, damage, or availability constraints.

The replacement bike will be of comparable type, specifications, and rental price, as determined solely by BiRide.

Riders will be informed of the substitution as soon as possible.

BiRide is not liable for any inconvenience, delays, or minor differences in equipment between the originally booked and replacement bike.

5. Payment and Fees

All rentals must be paid through the BiRide app, website, or in person, using approved payment methods.

All Bookings require €100 security deposit per bike that is refunded on return in satisfactory condition.

Prices are shown in EUR (€) and may include per-ride or wallet options.

Additional fees may be charged for:

➤ Non-return, damage, theft, or improper parking.

➤ Late return (at least one full day’s rental fee for each day overdue).

➤ Repairs, missing accessories, cleaning, service calls, administrative costs, contractual penalties, and loss of use.

BiRide may deduct such amounts from your deposit or payment method on file after providing a breakdown of charges as detailed in the Damage & Loss Fees Schedule.

6. Damage, Theft and Liability

You are responsible for the condition of the bicycle from the moment you unlock or collect it until it is properly returned and locked.

Mandatory Reporting (24-Hour Rule): You must report any accident, damage, or theft to BiRide immediately (max 24 hours) via email (admin@biride.com) or phone. Failure to report within 24 hours voids your Third-Party insurance coverage.

Financial Liability:

➤ You are liable for the first €500 of any Third-Party claim (Insurance Excess).

➤ You are fully liable for 100% of costs for repair or replacement of the BiRide bicycle/equipment.

7. Suspension or Termination

BiRide may suspend or terminate your access to the services, without notice, for violation of this agreement, unsafe riding, fraud, or misuse.

8. Privacy

BiRide processes your personal data in accordance with its Privacy Policy. This includes collection of ride activity, payment details, GPS location and other information necessary to operate the Services. Such data may be disclosed to law-enforcement authorities if required by law.

9. Changes to this Agreement

BiRide may update these terms at any time. Material changes will be communicated in advance where feasible. Your continued use of the Services after changes take effect constitutes your acceptance.

10. Dispute Resolution and Governing Law

Parties shall first attempt to resolve disputes in good faith within 30 days.

If unresolved, disputes shall be subject to arbitration or the courts of Pafos, Republic of Cyprus, at BiRide’s election.

This Agreement is governed exclusively by the laws of the Republic of Cyprus.

In the event of discrepancies between language versions, the English version prevails.

12. Liability Disclaimer

By renting and using a BiRide bicycle you acknowledge and agree that:

You ride at your own risk.

Except for the specific Third-Party Liability coverage provided (and subject to its exclusions), BiRide and Bisaggio Cyprus Ltd are not liable for personal injuries, property damage, theft, equipment loss, or any other incidents (including those caused by wet roads, rain, wind, or slippery surfaces).

You are solely responsible for ensuring the bicycle is safe before each ride.

You may not ride under the influence of alcohol, drugs, or any substances that impair judgment.

You accept full responsibility for your own safety and actions during the rental period.

12A. Baby Seat Use Disclaimer

If you choose to use a BiRide bicycle that is fitted with a child seat, you acknowledge and agree that:

The baby seat is installed by BiRide staff as a courtesy. BiRide does not guarantee the condition, suitability, or safety of the baby seat or its compatibility with your use.

You are solely responsible for ensuring that any child is properly seated, secured, and equipped with appropriate safety gear (helmet, harness, etc.).

You assume all risks associated with carrying a child, including injury, equipment failure, or death arising from the use or misuse of the baby seat.

To the fullest extent permitted by law, BiRide and its staff are not liable for any loss, injury, damage, or death resulting from the installation or use of the baby seat.

By using BiRide services you accept this Rider Agreement, and waive and release BiRide from all claims related to the baby seat or transport of a child on the rental bike.
